Decision to Deport means the deportation of foreigners in Turkey and enforcing an entry ban on them. The Directorate General of Migration Management or the relevant authority decides on the deportation of foreigners.
In Which Cases the Authorities Decide to Deport Someone?
Deportation occurs as a result of continuous activities such as violating a visa, engaging in illegal and/or immoral activities, being a danger to national security or health or working without a work permit.
The decision to deport can be given for a certain period of time or a lifelong entry ban to Turkey can be enforced. While there are many reasons for a foreigner to be deported, the most common reasons are exceeding the visa period or not extending the residence permit period and staying after the permit expires.
If the visa period is not extended there are different entry ban periods for each time period without a visa in Turkey. These are as follows:
In violation of up to 90 days; 3 months
In violation of 3-6 months; 6 months
In violation between 6 months and 1 year; 1 year
In violation of 1-2 years; 2 years
in violation for more than 2 years; 5 years entry ban is enforced.
However, if the visa period is not extended, a fine can be given under the name of visa penalty. In addition, citizens of some countries may have to pay a Visa Fee in addition to the visa penalty.
The amount of fine for visa violation varies according to how long the violation took place, how it happened, the length of stay in the country, and in which country the visa violation took place. Turkey has bilateral agreements with some countries regarding visa exemption.
are listed here. The visa penalty is calculated in USD at the amounts specified in the table for the visa-free months.
How to Revoke a Deportation Decision?
Removal or revocation of the deport decision can be possible in two ways. The first method is for the foreigner to obtain a valid visa and enter the country with this visa before the expiry of the deportation period, and the second method is to file an annulment case against the deport decision. This lawsuit can be filed in the administrative court of the place where the administration that made the deportation decision is located.
Depending on the reason for the deportation decision made about the foreigner, the rule of duty and authority is the same in the lawsuit to be filed for the annulment and removal of the code given to the person. In other words, a lawsuit should be filed in the administrative court of the place where the administration whose code is entered in the person's registry is located.
